FREDERICK, Md. (AP) — A judge has refused to move the trial of a man accused of wounding two students outside a high-school basketball game in Maryland.
Frederick County Circuit Judge Scott Rolle (RAH’-lee) denied the motion Tuesday. Brandon Tyler’s lawyer argued that heavy publicity about the shooting would make it impossible to seat an impartial jury.
Rolle ordered the trial postponed to May. It had been scheduled to begin Nov. 17.
Tyler is charged with four counts of first-degree assault, use of a handgun in a felony, reckless endangerment and a conspiracy charge.
Police say he wounded two boys, ages 14 and 15, outside the Frederick High School gymnasium on Feb. 4.
Co-defendant Chandler Davenport pleaded guilty in August to two counts of reckless endangerment.
